Appealing to the Appointed Person
Appointed Persons are experienced IP Law practitioners, appointed by the Lord Chancellor. They are an appeals tribunal to our decisions. Their decision is final, and there is no appeal to their decisions.
Appointed Person appeals procedure
This follows the same sequence as before our Hearing Officers.
Decisions can be taken from the papers on file or following a hearing. This is not a full re-hearing of the case but a consideration of whether the Hearing Officer was wrong in law , as claimed in the appeal documents, when taking their decisions.
To appeal to the Appointed Person you must:
- Send a Notice of appeal to the Appointed Person Form
TM55
(34Kb) (no
fee required) within 28 days after we issue our decision.
If you need more time to file the appeal then,
- Send a Request for an extension of time (Form TM9) with the appropriate fee
