Counterfeiting of trade marks
If someone deliberately uses your registered trade mark, without your knowledge or consent, they may be guilty of the crime of counterfeiting.
If there is sufficient evidence, the Police or Trading Standards Officers can take criminal proceedings under trade marks law.
We are not responsible for policing the Register of trade marks, and cannot advise you about what legal action to take to protect your mark.
If you suspect that someone is passing off, infringing, or counterfeiting goods or services under your mark, we recommend that you consult your local Trading Standards Office. You can also visit the official trading standards website for more information.
You can also seek appropriate professional help, from a solicitor or a trade marks attorney.
